Justices signal deep trouble for health care law

WASHINGTON – The fate of President Barack Obama’s health care overhaul was cast into deeper jeopardy Tuesday as the Supreme Court’s conservative justices sharply and repeatedly questioned its core requirement that virtually every American carry insurance. The court will now take up whether any remnant of the historic law can survive if that linchpin fails.

The justices’ questions in Tuesday’s hearing carried deeply serious implications but were sometimes flavored with fanciful suggestions. If the government can force people to buy health insurance, justices wanted to know, can it require people to buy burial insurance? Cellphones? Broccoli?

The law, pushed to passage by Obama and congressional Democrats two years ago, would affect nearly all Americans and extend insurance coverage to 30 million people who now lack it. Republicans are strongly opposed, including the presidential contenders now campaigning for the chance to challenge Obama in November.

The court focused on whether the mandate for Americans to have insurance “is a step beyond what our cases allow,” in the words of Justice Anthony Kennedy.

But Kennedy, who is often the swing vote on cases that divide the justices along ideological lines, also said he recognized the magnitude of the nation’s health care problems and seemed to suggest they would require a comprehensive solution.

He and Chief Justice John Roberts emerged as the apparent pivotal votes in the court’s decision. The ruling is due in June in the midst of a presidential election campaign that has focused in part on the new law.

Though many of the justices asked tough questions and made strong statements, past cases have shown that those don’t necessarily translate into votes when it comes time for a decision.

Wednesday’s final arguments – the third day in the unusually long series of hearings – will focus on whether the rest of the law can remain even if the insurance mandate is struck down and, separately, on the constitutionality of another provision expanding the federal-state Medicaid program.

The insurance requirement is intended to complement two unchallenged provisions of the law that require insurers to cover people regardless of existing medical conditions and limit how much they can charge in premiums based on a person’s age or health.

The law envisions that insurers will be able to accommodate older and sicker people without facing financial ruin because the insurance requirement will provide insurance companies with more premiums from healthy people to cover the increased costs of care.

The biggest issue, to which the justices returned repeatedly during two hours of arguments in a packed courtroom, was whether the government can force people to buy insurance.

“Purchase insurance in this case, something else in the next case,” Roberts said.

“If the government can do this, what else can it not do?” Justice Antonin Scalia asked. He and Justice Samuel Alito appeared likely to join with Justice Clarence Thomas, the only justice to ask no questions, to vote to strike down the key provision of the overhaul. The four Democratic appointees seemed ready to vote to uphold it.

Kennedy at one point said that allowing the government mandate would “change the relationship” between the government and U.S. citizens.

“Do you not have a heavy burden of justification to show authorization under the Constitution” for the individual mandate? asked Kennedy.

At another point, however, he also acknowledged the complexity of resolving the issue of paying for America’s health care needs.

“I think it is true that if most questions in life are matters of degree … the young person who is uninsured is uniquely proximately very close to affecting the rates of insurance and the costs of providing medical care in a way that is not true in other industries. That’s my concern in the case,” Kennedy said.

Roberts also spoke about the uniqueness of health care, which almost everyone uses at some point.

“Everybody is in this market, so that makes it very different than the market for cars or the other hypotheticals that you came up with, and all they’re regulating is how you pay for it,” Roberts said, paraphrasing the government’s argument.

Solicitor General Donald Verrilli Jr. sought to assure the court that the insurance mandate in the Patient Protection and Affordable Care Act that Obama signed into law in 2009 is a key part of the law’s goal of reaching many of the more than 40 million people who don’t have health insurance through their employers, don’t qualify for government aid and cannot afford to buy coverage on their own.

Paul Clement, who is representing Florida and 25 other states in challenging the law, called the mandate “an unprecedented effort by Congress.”

Clement, a predecessor of Verrilli’s as solicitor general, said the requirement would force people, especially those who are young and healthy, to buy a product they don’t want.

Michael Carvin, representing the National Federation of Independent Business in opposing the law, also pushed hard on the notion of individual freedom. When Justice Stephen Breyer asked if the federal government could not order vaccinations “if there was some terrible epidemic sweeping the United States,” Carvin said no. Congress lacks the power to do so, he said.

Justice Ruth Bader Ginsburg said she found the debate over health care similar to an earlier era’s argument about the Social Security retirement system. How could Congress be able to compel younger workers to contribute to Social Security but be limited in its ability to address health care? she wondered.

“There’s something very odd about that, that the government can take over the whole thing and we all say, oh, yes, that’s fine, but if the government wants to preserve private insurers, it can’t do that,” she said.

Scalia and Roberts noted that the health care overhaul law would make people get insurance for things they may not need, such as heart transplants or pregnancy services. “You can’t say that everybody is going to participate in substance abuse services,” Roberts said.

On the other hand, Ginsburg said, “The people who don’t participate in this market are making it more expensive for those who do.”

“You could say that about buying a car,” Scalia retorted, noting that if enough people don’t buy cars the cost could go up.

But, unlike cars, almost everyone eventually will be required to use the health care system, Verrilli said in defense of the law. Without health insurance, he said, “you’re going to the market without the ability to pay for what you’re going to get.”

Members of Congress on both sides of the fight sat through Tuesday’s arguments, along with Attorney General Eric Holder and Health and Human Services Secretary Kathleen Sebelius. Republicans opposed to the law in the audience included Senate Minority Leader Mitch McConnell of Kentucky, Sen. John Cornyn of Texas and Sen. Lindsey Graham of South Carolina. Also at the court were Democratic supporters including Sen. Pat Leahy of Vermont, Sen. Max Baucus of Montana and Reps. John Dingell and John Conyers, both of Michigan.

Demonstrators returned Tuesday to the sidewalk outside the Supreme Court, with more than 100 supporters of the law circling and chanting, “I love Obamacare.” They carried signs reading slogans such as “A healthy America is a productive America” and `’Protect the law.”

More than a dozen opponents held a news conference criticizing the bill.

Supporters, two of them wearing Statue of Liberty costumes, marched to music played over a loudspeaker. A trumpet player played “When the Saints Go Marching In” and “This Little Light of Mine,” and supporters changed the lyrics to ones supporting the health care law.

One demonstrator opposing the law wore a striped prison costume and held a sign, “Obama Care is Putting the US Tax Payer in Debtors Prison.”

Rep. Michele Bachmann of Minnesota, a former Republican presidential candidate, joined a tea party press conference of opponents of the law. Calling the law “the greatest expansion of federal power in the history of the country,” she said, “We are calling on the court today: Declare this law unconstitutional.”

    The Justices are supposed to be enforcing the Law of the Land WITHOUT coercion from the President or anyone else.If they are unable to do that and support Obama and his cronies in attempts to throw out the Constitution, then perhaps it is also time for their tenure to be abolished. The MUST be objective. Those appointed by the President are NOT beholden to him or his ideas. If the President become Ruler, there will be no reason to have  Justice Department.

      Michael, it is said that Each man kills that which he loves.  Ol’ female Ginsburg lied to get her fanny in the Supreme seat.  The ingrate took an Oath swearing to uphold the Constitution of the United States.  A week ago she brazenly told the Egyptians not to use the US Constitution as a template for theirs, instead use a European model, preferably one created after WWII.  She complained that she had a hard time working under ours. Clearly O also hates it and is having a “devil” of a time working “around” our Blessed Constitution. (Does anyone know who paid her transp, who gave her, a Jewess, the authority to speak to Egypt against our Constitution?)   To that female(?) I’d say Well hoop de doo, Ginsburg, what an embarrassment you are to your kind, to women and all who live and who have died as Americans.  You are not a slave, you are in a Free Country thanks to that Constitution, and can leave anytime you want, or just walk out of the SC, with us advising YOU not to let the screen door slap you in the rear as you leave.  (that means walk out fast.)  What an ingrate.  If it weren’t for that Christian principled Constitution, ol Ginzy’s elders and relatives and possibly herself, would be speaking German if speaking at all.  Dumb.  Ingrate.         It’s a crying shame that the supreme court,especially the liberals on the court,can’t see past party lines,to do the right thing.Without twisting the Constitution,where does it say the gov can force a citizen to buy a product.If they can’t look at the Constitution,and see plainly that nowhere does it say the gov can force a citizen to buy something,against their will,maybe they got no business,being on the bench!!

    Wow, I thought the supreme court determined if a law was constitutional or not!  I thought that was what they did.  So how is determining if ObamaCare is or is not constitutional considered judical activism?

    Obama is a constitutional law professor.  You would think he would know that!

    They are not creating a law, as they did with Rowe versus Wade.  That was judical activism, oddly Obama has no problem with that!

    I’ve been a Democrat all my live (I’m 70), but never have I seen a party that is hell bent on spending so much money, taking our health freedoms away from us, example Obama Care, I can’t believe that Obama, who taught Constitutional Law, doesn’t realize that this law is unconstitutional.  Refused the drill for more oil here, yet will tell the Saudies to drill more and we will buy from them.  Is Obama just ignorant of does he want us to be a 3rd world country?  I can’t believe that anyone would vote for him, unless you are getting a free Government hand-out and don’t want to give up the golden goose, using the working man’s taxes.  I will never vote Democrat again, the party has changed to much.

        Tired, me too.  Late and this is my last post.  We enjoyed most of the Viet Nam Memorial with Tom Seleck on Memorial Day.  We were laughing about O and Mrs. O standing with backs to camera during wreath placing at the VN wall.  O kept rubbing the back of the VN mom between the two of them as a rep of all parents who lost sons and daughters in ‘Nam.  Mrs. O tried to get in on it and kept bumping O’s hand which he didn’t like and pushed her away.  Finally he hugged the mom and pulled her closer to himself, away from Mrs. O.  Then there was a huge noise overhead and hey all looked up with concerned expressions.  Mrs. made studied glance over audience then returned face to the wreath placing.  We were hoping someone would shout DRONE!! DRONE!! and they would have dived or ran.  O is nervous now that he knows he can’t trust the Secret Serv to protect him.  That was quite a great strategy.  They just lost jobs and can get others, but they clearly told O where he stood with them.  Just wanted to comment that you are right that the Democrat Party was infiltrated… but by Commies, not socialists.  Indeed we must do something to ensure our votes are counted here in our country.  Countering Spain or any outside location, ask O what happens when the transport method fails and votes are dumped in the ocean etc.  Soros is not going to win this one.  Anyway why does he want our country, he has Israel… oh, is it true that Israel wants to take over the USA?  Stranger things have happened and with similar deceit.  Nite all.

    I don’t mind paying for health insurance because if I get a serious illness that requires hospital stay of a month or two I would be covered. I don’t like going to hospital knowing that the law says Hospital has to take care of me for free if I can’t afford a 80,000 dollar bill. Why would any of you want to pay for someone that wants everything for free? None of your post make any sense to me. Each of you that have insurance through your employer should know that your employer has to pay $1000 dollars more for each employee ,  tax payers” citizens, employers, in short everyone” pays for free medical care for the indigent. This means your employer is paying out higher health insurance premiums that could other wise go toward a raise for you. know matter how poor a person is they can afford to pay a small amount for their health insurance. This may mean that they may have to carry their lunch to work , give up a cup of coffee, cut back on their cable tv package, go from a cell phone to a land line or any other items they feel are necessary. School lunches, rent subsidies, food subsidies ect, are all ready offered to assist low income. Generous federal earn income tax credits are received by the low income worker also. So you see after, all of this aid is given to the lower income, it is not unreasonable to require them to pay a small amount for their health insurance. I’m for Obama heathcare! We have to pay for Social Security and Glad I payed in to it, I’m now retired and enjoy  the pay the monthly check I get, I have IRA’s that I put money in to so is to supplement my income , I live a good life thanks to our government that made this all possible. I here people say we need to get rid of  
    all government regulation , this would be a big mistake, This is way our banks got in to trouble, now the regulation are back so they can’t get greedy again. If Obama care gets struck down, then Republicans will get rid of Social Security and ect. I see very little thinking in some of these post .

      You have no concept of the concept of  ”being free” or having the liberty to make and accept responcibility for yourself.  Insurance is betting on getting sick. Pure and simple. We are the self employeed and our rates for 3 went up to $1800 per month. More than twice our house payment. University Profs who are friends of ours pay $35 for more coverage than we get but, they are subsidized by the taxpayers of the state and the Federal Government.  I have had some major illness throughout my life but I have worked both hard physically and smart by using some common sense.   What you are advocating is displacing our future generations income and liberties to satisfy your desire to prolong  your life at their expense.  I’ve paid enough into the system to sustain my life and several others  but, the Federal waste machine has used it up and they want to now tell us they need more. Simple accounting tells the story all to well. Waste, waste no productivity. Solyndra, Post Office, etc, etc all bloated on the backs of tax payer dollars. No real accountability or budgeting within means.
      Greece is ahead of us on the curve, yet they just put a hard line socialist into power. Same in France. Now they are talking about 75% tax rate. Massive movement of people picking up shop and looking for a new home like the UK. They are Next and we with them. A government that promises security can just as easily take it away with the same power. I believe in freedom and liberty, not more empty promises and bailed out banks. The only difference between a communist and a socialist democrat is a gun. The only difference between a sovereign citizen and a dictatorship is a gun with a better operator on the right end.

      I don’t want to sound petty, but I had a very difficult time understanding what you wrote due to your poor spelling, poor attempts at punctuation, and your lack of correct usage of grammar.  You do not understand, you just regurgitate what you hear on MSNBC.  This is a result of the lefts on-going agenda of “dumbing-down” the population through the public school system.  I agree with that people could do without certain luxuries, i.e.  cable TV, Starbucks coffee, unnecessary cell phones, etc.  etc.; but that is their prerogative to spend their earnings as they wish.  NOT have these things indirectly taken from them by a government that encourages free-loading to keep their office in Congress.  While you do project the illusion that you are capable of thinking to solve complex issues, you are in error in your opinion, and you do not understand what these people are saying in their posts.  I do not want to leave my grand-children living hand to mouth to pay for all the money that was carelessly wasted by the liberals that are only concerned with re-election, and how much money they, and their friends, can take under the color of law and abuse of office.  Mr. Jones, you come across as well-meaning, but you do not see the whole picture, and we can not afford to keep spending money we do not have, and will not have in the foreseeable future.  As I said; I do not want to come across as being petty about your mis-spellings, and poor use of the language, but there are spell checking options available to all that use the internet.  If you want people to listen to your argument, you will be more successful if people can understand what you are trying to say.  Please, research this topic to the utmost depth that you are able, giving equal consideration to all sides of the argument.  Do not let your personal feelings lead you, but use your deductive logic to understand the subject.   You may not change your opinion, but at least you might be better adept at participating in the forum of Constitutional Law.  There are “free” copies of the Constitution of the United States of America, online, and through any conservative news group / blog, and from the honest, but misguided, liberals that truly love their country, but do not see the Constitution for what it is:  The Law of the Land, not a “living document” to be interpreted to fit their agenda.

Death with dignity has been approved for the Mass. ballot, along with 6 ? other states. 15 -45 are the treatable ages. Like Europe, suicide is an option, and you won’t be making it……………

    I think that Obama has no respect for the Bible, God or our Constitution, maybe he thinks he’s God, I did hear him say that once on the news. Very scary guy who’s chopping away at our freedom’s in so many aspects, can’t even protest anymore without kids bing hurt or peppersprayed or worse, imprisoning Greenpeace and other activists even Xena Warroir Princess. Ithink you all better think twice before voting for someone who has a forged birth certificate run you into financial ruin. If you want to work until you’re 73 all of people are dieing way younger than that 15 year olds, 20 year olds, 30 year olds, dropping dead of heart attacks, seems mighty suspisious to me that Obama would try to take money from healthy young people who don’t need health care unless Obama has some kind of master plan to chemtrail you and posion your water with industrail waste called floride. WAKE UP SHEPLE, amrtial law and RFID chips are just around the corner for you. RFID CHIPS mark of the beast, don’t take this from the illuminati, skull and bones…cults are runnig your lives and your children are dissapearing 2000 a day having only GOD knows what happen to them!     This whole supreme court discussion is ludicrous. I live in a European country, where everyone is required to have health insurance, and it is a good thing. No one goes bankrupt for lack of medical insurance. No one is denied access to healthcare for lack of medical insurance. No one is without the peace of mind that comes for lack of medical insurance. No one needs to be afraid to lose medical coverage when losing a job. The US is a hundred years behind the times.

      Your reasoning is exactly while we had a revolution in the first place. We think and reason for ourselves. We believe in the liberty and freedom of the individual and not the hard line of the party or the state. We live in communities because we choose to do so or NOT! We like choices and when we could save people like me paid for their own medical choices and didn’t bet on insurance to maybe be there when times got hard. We’d rather die FREE than in bondage to the King or Government. Liberty gives opportunity to be self reliant and creative rather than stagnant like most of Europe. WE were a thousand years ahead of Europe and the rest of the world until we began having Democratic Socialists infiltrating our system with all sorts of obstacles. You don’t fear losing your insurance but you have your head where the sun don’t shine when it comes to understanding that your government and the EU are crumbling quickly. How will the insurance work for you when you have no clinics and no doctors to work in them? No money to pay them.  You offer nothing and you have no new solutions. You will have your insurance won’t you.
      We’ll do it on our own without the Democratic Socialists Regime.  I seem to remember coming to Europes aid on several occasions and pulling you from the ashes and helping to rebuild. Then you fools turned around and set up the very type of government that you were fighting against and that has never been successful without successive revolutions. Decidedly you have nothing to offer!

      I lived in Europe for 27 years under the German system. I paid 54% of my income in income taxes and social taxes(health and retirement) so all i have to say is keep your European Health insurance in Europe and stay out of Americas health insurance.

The midddle class disappeared when people like you began buying up everything as fast as you could when it was made with cheap communist slave labor.  The Chinese still execute poor perfomance workers or mangagement folks to keep the rest in line.  A friend of mine witnessed the execution of the management production staff of a major production facility to increase the production of the plant. All workers were lined up in military columns and positoned to witness the public execution of their bosses for not performing up to expectations of the party leaders locally. Go to or move to China or Russia and maybe Venezuala and come back when you are more fully educated, or at least have your eyes opened. . . if you survive?

       Your post shows your supreme ignorance.  The acts of Carter and Clinton in forcing the banks and mortgage companies are the cause of the current melt down. primarily in the housing market.  Next the  Bush’s administration and republicans tried to get congress under the full control of the democrats to reign in Freddi Mac and Fannie Mae but to no avail.  Currently the President has created a 5 Trillion deficit, more money in the three years he has been president than all presidents combined in all of history.  This will cause another financial meltdown in the near future.  The only thing we can hope for is that by then there will be adults running the administration and congress instead of the democrat  man child idiots who can’t find it with both hands.

    My wife has worked all her life and now has an irregular heart beat after having a heart attack. She has no health care and can’t get any due to pre-existing conditions. If she had health care and could get the meds that she can’t afford, she could go back to work and be a productive, tax paying member of the work force. That won’t happen though because the idiots in the government don’t care about helping the people who need it the most. All you idiots keep saying that you don’t want government involved in your personal lives but it’s ok for them to interfere in the lives of gays who want to be married or anyone else who has a different belief system then you because some book that some pedifile priest says it’s  against gods words. Yet it’s ok for all you bible thumping morons to selectively follow the rules you feel like unless it’s inconvenient. Either do what the bible says all the time or shut the fck up and use your brains. Your just a bunch of self centered hypocritical bigots.

    The justices should not be repeating this mantra that “the mandate” is more onerous for young people because “they don’t need it”. Is it that the justices are of such advanced age that they think healthcare insurance is only necessary for the elderly? Large and hugely expensive health costs are also incurred disproportionately by younger people– having babies, especially preterm; catastrophic costs due to accidents, not just vehicular, but bikes, skateboards, accidents on the farm, around the house, on the playground, the sports fields, etc. Other ER services, such as those related to violence (gunshot and all other), drug overdoses, infectious diseases (STDs), are disproportionately administered to younger people.

    Healthcare costs– like those incurred unexpectedly by accident and treated in ERs– are part of what drives overall health insurance premiums– those bundled payments (mine, yours, and everyone else’s) maintain hospitals, so that there is one to rush to in any emergency.

    If you go to the hospital to have your appendix removed, it’s done in the OR, and the OR charge (hourly rate) is set according to all that goes on in an OR, most of which you certainly will not be treated to during an appendectomy, and possibly not ever in your life.

    We are all bundled already, payers & non-payers together. The calculations include almost everyone (actuarially), but less than everyone makes payments. There is no such thing as any individual only paying for their “own” health care. What’s shocking is how little the justices understand about how healthcare costs work in this country. No wonder they have so little understanding of how healthcare and broccoli markets have nothing in common, most of all any similar claim to a national interest mediated by the government.

    How is the question of universal healthcare so confused? The debate centers on whether people can be forced to purchase healthcare. Is there anyone out there that really believes that everyone does not already have access to healthcare? The sick and injured flock to hospitals and emergency rooms whenever there is a need. Who pays? The rest of us with healthcare! The Supreme Court justices ought to consider the question of should people be forced to PAY FOR THE HEALTHCARE  THEY RECIEVE, even though they refuse to buy insurance and freeload on the rest of us. All the consternation about the rights of citizens being forced into a mandate to “buy”, how many have no coverage yet collect the benefit of care payed for by the rest of us. The question should be framed as not a “mandate to purchase” but rather a “mandate to pay for the benefits already presumed.” If the Supreme Court decides against the healthcare law, then I hope there is an immediate safe haven law passed that allows the denial of any and all healthcare to anyone and everyone without insurance. How fast will the country of freeloaders turn on their heels and squeal when they find the doors of medicine blocked for them and their families. I don’t mean to be mean, but at some point, the realization that healthcare is truly available to all should lead to the realization that all should also pay for that benefit.

     It is not the government’s responsibility to provide healthcare to anybody but our military personnel.  And they should DO that to the utmost.  Those who have paid int the Medicare program are entitled tho these benefits. Other than that, government should not be involved in the healthcare business and therefore should not be ordering American citizens to purchase insurance.  The states should be taking care of the REAL DESERVING POOR. Get the federal government out of it.
